Do you need an EPA?
When injury or illness means you’re unable to make important decisions or manage your own affairs – an attorney appointed through an enduring power of attorney (EPA) can step in and take on important responsibilities for you. Every adult New Zealander deserves the reassurance that their wishes will be respected in times of need. Without an EPA in place, even those closest to you – like your spouse, partner or next of kin – may not have the legal authority to step in and make decisions on your behalf.
There are two types of EPA:
An EPA for property allows someone you trust to take care of things like paying bills and managing assets, and an EPA for personal care and welfare appoints an attorney to make decisions about your wellbeing like where you’ll live and what care you can receive. Having both in place helps ensure that no matter what happens, someone can step in and act for you if you're unable to. With both types, you should name a trusted person that has the capability to make important decisions and your best interests at heart.
